Agreement This agreement is between John Keppler Photo (Photographer) and the "Responsible Party" (Client) as designated below. The Photographer agrees to provide wedding photography at the places, dates, and times specified in the "signed agreement." If, for any reason, he cannot fill that obligation, the Photographer must provide a substitute of his choosing to provide the same service. The non-refundable deposit secures the dates and times for the services to be performed. Although the deposit is not refundable, if photography is cancelled, it will remain as a 1-year credit toward any photography or prints. The Client agrees to pay the balance of the payment at the time of the event.
Wedding Photography The photographer will capture the day in a manner that is agreed on, and pleasing to the clients. Keppler Photo is not responsible for capturing images that aren't requested. The photographer is experienced and will, by default, seek to organize the wedding party for many of the traditional photographs (as well as spontaneous candid shots as time and circumstances allow). However, weddings involve many unforeseen circumstances that sometimes preclude the taking of certain pictures. These circumstances may include time constraints, late members of the party, or even the client desiring a shot, but forgetting to ask for it. Because the client is responsible for requesting specific shots, Keppler Photo offers a list of possible shots that the client may approve before the event. Even with this list of desired photographs, the client hereby agrees that they maintain the responsibility of seeing that any specific photographs are taken. This is done by reviewing the photography list with the photographer on the day of the event, so the client can prioritize photographs as wedding circumstances change and may necessitate the altering of the list.
Image Rights and Format The Photographer maintains full rights to images photographed under this agreement, and may reproduce them in any form as well as license the rights commercially. The Client receives a permanent license to the images for personal use and reproduction (including printing and emailing). The client may not use the images for commercial purposes. The client will receive all of the full resolution images on archival CD-R's, in JPEG format, and the original negatives after 12 months. Images will receive basic color and exposure corrections. Reproduction quality will depend on the properties of the devices that the images will be printed to. In other words, 1-hour photo labs may or may not reproduce images accurately, and poor prints are not the responsibility of Keppler Photo. Clients are encouraged to use professional (custom) labs or Keppler Photo printing services to get best results.
Receiving Images The client will be emailed a document for ordering proofs and prints. The client may order the prints at anytime - but after one year from the date of photography, Bair Photography will charge a $50 unarchiving fee to fulfil the any print orders from packages. However, if the client makes a paying order of $50 or more, the fee is waived. Once the client has the images on CD, Keppler Photo is not obligated to have the files on hand - however, Keppler Photo does archive and back-up every image, so the images should always be available through them.
Limited Liability The Photographer's liability is limited to fulfilling this agreement or to return all deposits made by the Client.
Being on Time Both the Photographer and Client are expected to be on time and ready for photography according to the times stated above. If the client or anyone from their party is late, the time the photographer spents waiting will still be counted towards the time agreed upon in this contract. Additional photography time can be added for any reason at the time of the shoot, but the Client agrees that time will cost an additional $75/half hour. If the Photographer is late, the time the client spends waiting for the Photographer is NOT counted toward the time agreed to in this contract, and the photogrpher is obligated to fulfill the full amount of time agreed to in this document.
Sole Photographer The client will actively work to help the photographer do their job by ensuring that videographers and amateur photographers don't get in the way. In the end, however, Keppler Photo will be paid even if the client allows others to get in the way. In other words, relatives and friends CAN take pictures while the photographer is working IF the Client allows it, but they might impair the photographer's work and the eventual quality of the product.
